Terms of Service
Last updated 3 October 2026.
These Terms of Service ("Terms") govern your use of Peak, a service operated by Stratus Studios LLC ("Stratus Studios", "we", "us"). By creating an account, registering a gallery, or opening a gallery through an access link, you agree to these Terms. If you do not agree, do not use Peak.
1. The service
Peak delivers photographs it does not hold. An account holder registers a gallery backed by object storage, creates an access link, and sends that link to a recipient. Peak checks the link and gives the recipient's browser a short-lived signed URL; the storage then serves the image bytes directly. Peak keeps no copy of the photographs. What Peak stores, and what it never stores, is described on the Privacy page.
2. Accounts
To register galleries you sign in through our identity provider. You are responsible for keeping your sign-in credentials secure and for everything done under your account. You must give accurate information and be old enough to form a binding contract where you live. One account belongs to one person or organization; do not share it or let anyone else register galleries as you.
3. Your content and your storage
You keep every right you already hold in the photographs and other content you deliver through Peak. We claim no ownership of it. You grant us only the limited permission we need to run the service: to read the names of the objects in your storage, to generate signed URLs so your recipients can fetch them, and, where you use storage that Peak provides, to store the files you upload.
You are responsible for having the rights to the content you deliver, including the rights of anyone depicted in it, and for having permission to share it with the recipients you choose.
Where a gallery reads storage you provide, that storage account is yours. You are responsible for it, for its cost, for its credentials, and for its availability. Peak reads object names and signs URLs against it; it does not control it. Where a gallery uses storage that Peak provides, Peak holds the files, but the content and its lawful use remain yours.
Where you use storage that Peak provides, you also permit us to apply automated scanning and analysis to the images stored there, in order to comply with any and all federal, state and local laws and regulations.
4. Access links and recipients
An access link is a credential. Anyone who holds a link can open the gallery it points to until the link expires or you revoke it. You decide who receives a link, when it expires, and when to revoke it. Keep links only with people you mean to give access to.
A recipient holds no account and needs none. If you received a link and use it to open a gallery, these Terms apply to that use, and the acceptable-use rules below apply to you as well.
5. Acceptable use
You agree not to use Peak to:
- deliver content that is unlawful, or that infringes or misappropriates anyone's rights;
- deliver sexual content involving minors, or any content that exploits or endangers a child;
- harass, threaten, defame or violate the privacy of another person;
- distribute malware, or content designed to harm a recipient's device;
- probe, breach or circumvent the access control, reach a gallery you were not given a link to, or interfere with Peak's operation or with other users;
- resell or offer the service to others as your own, except as we agree in writing.
We may remove access to content or suspend an account that breaks these rules, and we may report unlawful content to the authorities where the law requires it.
6. Subscriptions and billing
Every organization may register up to 2 galleries at no charge. A paid plan raises that limit to 100 galleries and costs $20 per month or $200 per year. It is billed through Stripe as a subscription that renews for successive periods until you cancel. You can switch between monthly and yearly billing, or cancel, at any time through the billing portal; a change takes effect according to the plan you chose. If you need more than 100 galleries, contact support@sharepeakgalleries.com.
Peak stores no card details. Stripe processes payments and holds that information under its own terms. Fees already paid are non-refundable except where the law requires otherwise.
Cancelling a subscription returns your limit to what it was without the paid plan. It does not delete galleries or content, and galleries you already have keep working; it prevents you from registering new galleries above that limit.
7. Availability and changes to the service
We work to keep Peak available, but we do not promise it will be uninterrupted or error-free. We may change, add or remove features, and we may perform maintenance that makes the service briefly unavailable. Because a gallery can read storage you control, its availability also depends on that storage, which is outside our control.
8. Termination
You may stop using Peak at any time. We may suspend or end your access if you break these Terms, if the law requires it, or if we stop offering the service. When your access ends, the permissions you granted us end with it, except where we must keep limited records to meet a legal obligation. Storage you control, and the content in it, remain yours throughout.
9. Disclaimers
Peak is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will meet your requirements or that any defect will be corrected.
10. Limitation of liability
To the fullest extent permitted by law, Stratus Studios will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, revenue or profit, arising out of or relating to your use of Peak. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid us for the service in the twelve months before the claim, or one hundred United States dollars.
11. Indemnification
You agree to defend, indemnify and hold harmless Stratus Studios from any claim, loss or expense, including reasonable legal fees, arising out of the content you deliver through Peak, your use of the service, or your breach of these Terms.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the date at the top of this page. If a change is material, we will make reasonable efforts to tell you. Continuing to use Peak after a change takes effect means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. The state and federal courts located in California will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or your use of Peak, and you consent to their jurisdiction.
